TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern all programs, services, retreats, immersions, live events, live group sessions, digital products, memberships, educational materials, and experiences offered by Collective Healing Arts LLC, a Utah limited liability company, Jessica Endicott, and all affiliated brands, programs, and methodologies, including but not limited to Cognitive Harmony™ and Rooted & Rewired™ (collectively, the “Company,” “we,” “us,” or “our”).

By registering for, purchasing, accessing, or participating in any offering, you (“Client,” “Participant,” or “you”) acknowledge that you have read, understood, and agree to be legally bound by these Terms.


1. Scope of Services

The Company provides educational, coaching, wellness, and self-development services, including but not limited to:

One-on-one coaching

Group coaching (online and live)

Live group sessions

Digital programs and courses

Memberships and subscriptions

In-person retreats, immersions, and live events

All services are educational and experiential in nature.


2. No Medical, Mental Health, or Legal Advice

The Company does not provide medical, mental health, psychological, psychiatric, or legal services.

No diagnosis, treatment, or medical advice is provided

Services are not a substitute for professional care

You are solely responsible for your physical, mental, and emotional well-being

You agree to consult qualified professionals for any health or mental health concerns.


3. Eligibility

Services are intended for individuals 18 years of age or older, except where minor participation is expressly permitted with parental consent as outlined below.


4. Participant Responsibility & Assumption of Risk

Participation may involve emotional, physical, or psychological experiences. You voluntarily assume all risks associated with participation and accept full responsibility for your decisions, actions, and outcomes.


5. Code of Conduct

Participants must behave in a respectful, responsible, and safe manner.

Prohibited conduct includes, but is not limited to:

Disruptive, abusive, aggressive, or threatening behavior

Harassment, discrimination, or intimidation of any kind

Violation of group safety, confidentiality, or boundaries

Unauthorized recording or distribution of materials

Misuse of intellectual property

Conduct that interferes with the experience or safety of others

Failure to follow facilitator instructions


6. Intoxication & Substance Use Policy

Participation while under the influence of alcohol, recreational drugs, non-prescribed controlled substances, or any substance that impairs judgment or behavior is strictly prohibited at all live events, retreats, immersions, and group sessions.

The Company reserves sole discretion to determine impairment.

Violation may result in immediate removal and permanent revocation of access without refund.


7. Right to Refuse Service & Revoke Access

The Company reserves the unconditional right, at its sole discretion, to refuse service, remove a participant, or revoke access to any program, event, recording, platform, or material if a participant:

Violates these Terms

Disrupts the group or learning environment

Engages in unsafe, unethical, or inappropriate conduct

Misuses or infringes intellectual property

Violates community standards or boundaries

Fails to meet payment obligations

Removal or termination does not entitle the participant to any refund or compensation.


8. Minor Participation & Parental Consent

The Company’s services are primarily intended for adults.
In limited circumstances, participation by individuals under the age of 18 is permitted only with express, written consent of a parent or legal guardian.

By enrolling a minor, the parent or legal guardian represents and agrees that:

They are the minor’s legal parent or guardian

They have authority to provide consent

They have reviewed and agreed to these Terms, the Privacy Policy, and the Refund Policy on behalf of the minor

They assume full responsibility for the minor’s participation, conduct, decisions, and outcomes

They understand services are educational and coaching-based, not medical, therapeutic, or clinical

They acknowledge that the Company does not provide emergency or crisis services

The Company reserves the right to refuse or terminate a minor’s participation at any time for safety, conduct, or program integrity reasons, without refund.


9. Recordings & Use of Likeness

Live sessions, group calls, retreats, or events may be recorded for educational, replay, or internal purposes.

By participating, you consent to being recorded. The Company does not intentionally use identifying information for marketing without consent, though incidental inclusion may occur.


10. Community Spaces

Participation in online communities, forums, or group chats is subject to moderation. The Company reserves the right to remove content or participants to maintain safety and integrity.


11. Intellectual Property

All content, materials, frameworks, recordings, trademarks, methodologies, and program materials are the exclusive intellectual property of the Company.

You may not copy, reproduce, distribute, sell, sublicense, teach, or use Company materials for commercial purposes without written permission.


12. Enforcement, Injunctive Relief & Attorneys’ Fees

You acknowledge that misuse of Company materials may cause irreparable harm.

The Company is entitled to seek:

Injunctive relief

Actual damages, including lost profits

Recovery of attorneys’ fees, costs, and expenses

These remedies are cumulative and do not limit other legal rights.


13. Payment, Refunds & Cancellations

All payments are governed by the Refund & Cancellation Policy, which is incorporated by reference.

All sales are final. No refunds, credits, or transfers.


14. Chargebacks & Payment Disputes

You agree not to initiate chargebacks or payment disputes.

Any chargeback constitutes a material breach of these Terms. The Company reserves the right to dispute chargebacks and recover administrative, processing, and legal fees.


15. Third-Party Platforms

The Company uses third-party platforms for communication, scheduling, content delivery, and payment processing.

The Company is not responsible for the availability, security, or policies of third-party services.


16. HIPAA Disclaimer & Health Information

The Company is not a HIPAA-covered entity.

While HIPAA-compliant or HIPAA-capable technology platforms may be used, this does not create a HIPAA-covered relationship.

Information shared is not considered Protected Health Information (PHI) and does not constitute a medical record.


17. No Emergency or Crisis Services

The Company does not provide emergency, medical, or mental health crisis services.

If you are experiencing an emergency, contact local emergency services or a qualified professional immediately.


18. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from participation.


19. Indemnification

You agree to indemnify and hold harmless the Company from any claims, damages, losses, or expenses arising from your participation, conduct, or violation of these Terms.


20. Governing Law & Venue

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles.

All disputes shall be resolved exclusively in Utah.


21. Severability

If any provision is deemed unenforceable, the remaining provisions shall remain in full force and effect.


22. Acknowledgment & Acceptance

By registering for or participating in any offering, you confirm that you have read, understood, and agree to be bound by these Terms.
